Electronic Christian Media License Agreement The Scroll, Multimedia Study Bible for Windows, CD-ROM Version 1
ATTENTION: THIS IS A LICENSE, NOT A SALE. THIS PRODUCT IS PROVIDED UNDER THE FOLLOWING LICENSE WHICH DEFINES WHAT YOU MAY DO WITH THE PRODUT, AND CONTAINS LIMITATIONS ON WARRANTIES AND YOUR REMEDIES.
IMPORTANT: CAREFULLY READ THIS LICENSE BEFORE USING THE PRODUCT, USING THE PRODUCT INDICATES YOUR ACKNOWLEDGEMENT THAT YOU HAVE READ THIS LICENSE AND AGREE TO ITS TERMS. IF YOU DO NOT AGREE, RETURN THIS PRODUCT COMPLETE TO ELECTRONIC CHRISTIAN MEDIA WITHIN 10 DAYS OF THE DATE YOU ACQUIRED IT, FOR A FULL REFUND. THIS LICENSE AGREEMENT IS YOUR PROOF OF LICENSE.
GRANT OF LICENSE. GRANT OF LICENSE. You (an entity or a person) may use one copy of the software product identified above ("Software") on a single computer. You may use the software on a network provided you have purchased Software equal to the maxium number of copies in use at one time. The Software is "in use" on a computer when it is resident in memory (i.e., RAM) or installed (executable and other files) on the hard disk or other disk or other storage device. Software installed on a server for distribution purposes only is not considered "in use". If the Software is stored on a computer other than a network server, then the primary user may also use the Software on his/her home and/or lap-top computer, provided the Software is used on only one computer at a time. You may make one (1) archival copy of the Software.
ADDENDUM. The Software may be used for educational purposes in schools and Churches for teaching and instructional purposes only. Requests for quotations in excess of 2,000 words must be directed to and written approval received from Electronic Christian Media, 19 Dresden St. Riverview, NB E1B 3G8
Extracts from the Scroll, Multimedia Study Bible may be used in a work in any form without the express permission of ECM, provided that the work is not offered for sale, the quotes or extracts do not total more than 2,000 words and no more than 50 copies are made in any form. The images may be copied for educational use in any form with the exception of Corel Corporation images which must not be printed or reproduced in any form. The images must not be altered in any way other than to improve their appearance for any given output device. Each extract or image must be clearly marked as having come from The Scroll, Multimedia Study Bible, and must acknowledge the title and author of the article or image from which the item came. Any usage beyond this must be approved in writing by Electronic Christian Media.
RESTRICTIONS. You may not alter, merge, modify or adapt this Software in any way including disassembling or decompiling. You may not loan, rent, lease or license this Software or any copy. You may transfer the Software provided you transfer the Software and all documentation and media and you do not retain any copies.
COPYRIGHT AND TRADEMARKS. The Scroll Multimedia Study Bible for Windows software is copyright 1995 by David and Jane Graves, Electronic Christian Media. ("ECM") All rights reserved. All intellectual property rights in the Software and user documentation are owned by ECM or its suppliers and are protected by United States and Canadian copyright laws, other applicable copyright laws, and international treaty provisions. ECM retains all rights not expressly granted. The Scroll Multimedia Study Bible for Windows software, documentation, or portions thereof may not be reproduced in any form, (except as permitted within the license agreement) without the written permission of David and Jane Graves, ECM. IBM is a registered trademark and PC is a trademark of International Business Machines Corporation. Microsoft and Microsoft Mouse are registered trademarks of Microsoft Corporation.
LIMITED WARRANTY. For ninety (90) days from your date of purchase, ECM warrants that (i) the Software shall substantially conform to the applicable user documentation and (ii) that the magnetic media on which the Software is distributed and the user documentation are free from defects in materials and workmanship. ECM shall, at its option, refund the amount you paid for the Software or provide you with corrected items provided that the defective item(s) is returned to ECM within ninety (90) days from the date of purchase. Any replacement items shall be subject to a thirty (30)day warranty from your date of receipt and will be subject to the terms of this agreement. These are your sole remedies for any breach of warranty. Except as specificically provided herein, ECM makes no warranty or representation, promise or guarantee, etiehr express or inplied statutory or otherwise, with respect to this Software or user documentation, including, their quality, performance, merchantibility, or fitness for a particular purpose. The warranty and remedies set forth herein are exclusive and in lieu of all others, oral or written, express or implied. No ECM dealer, distributor, agent or employee is authorized to make any modification or addition to this warranty.
LIMITATION OF LIABILITY. Because software is inherently complex and may not be completely free of errors, you are advised to verify your work and to make backup copies. In no event will ECM be liable for indirect, special, incidental, economic, cover or consequential damages arising out of the use of or inability to use the Software or user documentation, even if advised of the possibility of such damages. In no case shall ECM liability exceed the amount paid by you for the Software. Some states do not allow the exclusion or limitation of implied warranties or limitation of liability for incidential or consequential damages, so the above limitation or exclusion may not apply to you.
RESTRICTED RIGHTS. The software and documentation are provided with restricted rights if acquired by or for the U.S. Government and are proprietary to ECM. Use, duplication, or disclosure by the U.S. Government, any state, local or federal goverment in or of Canada is subject to restrictions as set forth in subparagraph (c)(I)(iii) of The Rights in Technical Data and Computer Software-Restricted Rights atDFARS 252.227-7013, or subparagraph (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, or clause 18-52.227-86(d) of the NASA Supplement to the FAR, as applicable.
GOVERNING LAW. This license is the entire agreement between us, supersedes any other agreement or discussions, oral or written and may not be changed except by a written signed agreement. This License shall be governed by and construed in accordance with the laws of the Provice of New Brunswick, Canada, excluding the U.N. Convention on Contracts for the International Sale of Goods and the venue of any trial shall be in the City of Moncton, in the Province of New Brunswick, Canada. If any provision of this License is declared by a Court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed from the License and the other provisions shall remain in full force and effect. The parties have requested that this Agreement and all documents contemplated hereby be drawn up in English.
